I would like to participate in a herding clinic / class / event at Funky Town K9 Academy LLC also known as Arcadia Ranch. I represent, acknowledge, understand, and agree to each of the following:
WARNING: UNDER TEXAS LAW (CHAPTER 87, CIVIL PRACTICE AND REMEDIES CODE), A FARM ANIMAL PROFESSIONAL IS NOT LIABLE FOR AN INJURY TO OR THE DEATH OF A PARTICIPANT IN FARM ANIMAL ACTIVITIES RESULTING FROM THE INHERENT RISKS OF FARM ANIMAL ACTIVITIES.

I waive and release any right I, my heirs, distributes, guardians, legal representatives, and assigns may have or require to make claim against, sue, attach the property of, or prosecute Arcadia Ranch, FunkyTown K9 Academy, LLC, Duane or Jacqueline Tinker or any of its owners, agents, employees, volunteers, and affiliated organizations (hereinafter referred to as “THE RELEASEES”) for monetary damages caused by injury to my dog(s), myself, or the property of my dog or myself arising from my dog(s) participation in herding and the use of the facilities and property of Duane and Jacqueline Tinker, whether or not the injury or damage results from the negligence or other action, except intentional acts, of any of THE RELEASEES.

I understand that herding is a physical activity for me and my dog and the livestock and can be dangerous. I am aware that there are serious risks involved with herding to both myself and my dog(s) including but not limited to being kicked, run over, contacted by livestock, falls, poor footing, debris on ground, contact with fences, gates, or any other potentially hazardous condition associated with herding.

I agree to pay the FULL cost of the current market value for any livestock who is terminated because of the actions of me or my dog(s) whether intentional or accidental. I agree to pay the FULL veterinary bill for any livestock injured resulting from the actions of me or my dog(s) whether intentional or accidental, up to the full cost of the current market value of the animal.
